Merlin Annual Pass Terms & Conditions

Introductory Terms

1.            These are the terms and conditions ("Terms") on which Merlin Entertainments (Australia) Pty Ltd (“Merlin Entertainments Group”, “we” or “us”) we supply Merlin annual passes ("Merlin Annual Pass") to you ("Passholder" or "you"). Please read these Terms carefully before you submit your order for any Merlin Annual Pass to us. These Terms tell you who we are, how we will provide the Merlin Annual Pass to you, what to do if there is a problem and other important information. 

2.            By purchasing a Merlin Annual Pass you agree to be bound by and comply with these Terms and Conditions of use as amended from time to time. In addition, the purchase and use of a Merlin Annual Pass must at all times be in accordance with the regulations of each individual Attraction of Merlin Entertainments Group, copies of which are displayed at each Attraction or can be obtained on individual attraction websites, which can be accessed via www.merlinannualpass.com.au. By purchasing a Merlin Annual Pass you agree to be bound by and comply with the regulations for each Attraction in respect of your use of your Merlin Annual Pass.

3.            A Merlin Annual Pass will only be valid when it is used and/or presented by the person in whose name the Merlin Annual Pass was issued (identification may be required), it is presented by a person who is a true likeness to the photograph of the pass holder on the Merlin Annual Pass, and the Merlin Annual Pass is within the validity period (as defined in clause 14). The actual digital issued version (and not just a screenshot of it) must be presented for entry at an attraction - photocopies of a Merlin Annual Pass will not be accepted.

4.            Any use of a Merlin Annual Pass in breach of these terms and conditions or the relevant attraction regulations will result in the Merlin Annual Pass being revoked without compensation. For the avoidance of doubt, pass sharing is a breach of these terms and conditions and any attempted use of a Merlin Annual Pass by someone other than the valid pass holder, regardless of reason, will result in the Merlin Annual Pass being revoked without compensation to the holder.

Types of Merlin Annual Passes

5.            From the 9 March 2026, there will be only one variety of Merlin Annual Pass available for purchase;

(a)           The Merlin Annual Pass

6.            Additional varieties of Merlin Annual Pass which, from 9 March 2026, will no longer be available for purchase, but may still be valid for use, include:

(a)           The Gold Merlin Annual Pass; and

(b)           The Platinum Merlin Annual Pass

7.            These Terms will apply differently to the various types of Merlin Annual Passes, as further specified below. Please note, the Gold Merlin Annual Pass is not valid for entry within school holidays or public holidays. Dates detailed below in clause 15.

8.            The Merlin Annual Pass is purchased as an ‘Individual Pass’, valid for people aged 2 and over. From 9 March 2026, there will be no child or adult passes.

Issue of Merlin Annual Passes

9.            Each Merlin Annual Pass purchaser will be issued his or her own Merlin Annual Pass and as a condition of purchase, they will be required to supply the following:

(a)           their first name and surname;

(b)           their date of birth;

(c)           their residential address;

(d)           a contact telephone number;

(e)           a contact email address (if they have one); and

(f)            a photograph which must be a true likeness of the holder.

10.          Each child or adult will be issued with his or her own Merlin Annual Pass and, for the avoidance of doubt, each person will be required to supply the details listed in clause 9 and each member will be considered to be a “Passholder” for the purposes of these Terms.

11.          The purchaser of a Merlin Annual Pass must be aged 18 years or over.

Attractions

12.          The Merlin Entertainments Group attractions that are part of the Merlin Annual Pass scheme in Australia and New Zealand are: SEA LIFE Sydney Aquarium, WILD LIFE Sydney Zoo, Sydney Tower Eye, Madame Tussauds Sydney, LEGOLAND® Discovery Centre Melbourne, SEA LIFE Melbourne Aquarium, SEA LIFE Sunshine Coast and Kelly Tarlton’s SEA LIFE Aquarium (each, an “Attraction”).

13.          Other Merlin Entertainments Group attractions throughout the world are not part of the Merlin Annual Pass scheme in Australia and New Zealand.

14.          The Merlin Entertainments Group, in its absolute discretion, reserves the right to vary the opening and closing dates of the Attractions and to close, remove or cancel all or any part of the facilities within the Attractions for any reason including, but not limited to technical, health and safety and/or operational reasons or due to special events or private functions. For the avoidance of doubt, the full value or any part of the value of the Merlin Annual Pass will not be refunded nor will any compensation be payable if any of the Attractions become unavailable or if any or part of any of the Attractions are closed or removed from the Merlin Annual Pass scheme.

Entry to Attractions

15.          A Merlin Annual Pass entitles each Passholder to admission to the Attractions for a period of 12 months from the date of issue until the “valid until’ date (“Validity Period”) and may only be used in accordance with the operating calendars of each Attraction and any applicable exclusion dates/events. The ‘valid until’ date will be clearly identified on the Merlin Annual Pass digital pass when issued, however a Passholder holder is responsible for checking individual Attraction opening and closing dates before visiting.

16.          Entry date restrictions, or ‘blackout days’ vary for the different Merlin Annual Pass varieties;

(a)           The ‘Merlin Annual Pass’, purchased on or after 9 March 2026, allows entry to the Attractions for 12 months.

(b)           The ‘Platinum Merlin Annual Pass’, purchased before 9 March 2026, allows entry to the Attractions for 12 months.

(c)           The ‘Gold Annual Passes’, purchased before 9 March 2026, are not valid on public holidays and during the following school holiday dates in Australia. 17.          To use a Merlin Annual Pass for standard entry to an Attraction, the Passholder must present a valid Merlin Annual Pass at the admissions office, turnstile or other authorised entry point of the relevant Attraction.

18.          A Merlin Annual Pass is only valid for standard entry to the Attractions.

19.          A Merlin Annual Pass is subject to additional charges as advised by Merlin Entertainments Group from time to time for entry into:

(a)           any special events taking place at the Attractions;

(b)           any additional tours or experiences, including, but not limited to:

(i)            Shark Dive Xtreme;

(ii)           Behind the Scenes Tours;

(iii)          Animal Experiences (such as Penguin Encounters or Swimming with the Seals);

(iv)          SKYWALK;

(v)           Special events (such as New Years Eve at Sydney Tower Eye);

(vi)          Birthday Parties, Weddings, Corporate Events; or

(vii)        Packages, and combination tickets.

(c)           any other event as determined by Merlin Entertainments Group from time to time in its sole discretion.

20.          Possession or use of the Merlin Annual Pass does not guarantee immediate entry of the Passholder to any Attraction during peak times.

21.          Possession of a Merlin Annual Pass does not guarantee entry to the Attractions. The management of the relevant Attraction reserves the right to refuse admission for any reason as provided by each Attraction’s regulations including, but not being limited to, the Attraction reaching full capacity. 

22.          Entry to an Attraction by use of a Merlin Annual Pass will not be permitted in the event that a valid verified Merlin Annual Pass cannot be presented for any reason. This includes, but is not limited to, access to the Merlin Annual Pass being lost through no longer having access to the account or device on or through which the Merlin Annual Pass can be retrieved, Failure to present a valid verified Merlin Annual Pass will result in a charge of the “on the day” admission rate applicable to the relevant Attraction, which will be non-refundable. Merlin reserves the right not to honour a Merlin Annual Pass if Merlin reasonably suspects the Merlin Annual Pass has been stolen or copied.

23.          Passholders are required to pre-book timeslots prior to their visit to any Attraction. Time-slots are free of charge and can be booked online for each Attraction, however, immediate entry may not be guaranteed depending on the availabilities on the day of your visit.

(a)           Pre-booking online for is essential during weekends, school holidays and on public holidays to be admitted entry, for those passes which are valid for these dates.

 

Renewal

24.          Once a Merlin Annual Pass reaches its expiry date the Passholder will qualify for a special renewal offer provided that he or she renews their Merlin Annual Pass within 8 weeks of expiry and is able to present their expired Merlin Annual Pass when making the renewal. The Validity Period for the new Merlin Annual Pass will commence on the ‘valid until’ date of the expired Merlin Annual Pass.

25.          A Merlin Annual Pass that is not renewed within 8 weeks of expiration will no longer qualify for the renewal rate and the full price of a new Merlin Annual Pass will be chargeable.

Other

26.          All Merlin Annual Passes remain the property of The Merlin Entertainments Group. Merlin Annual Passes are non-transferable and cannot be sold, loaned or given away to or used by any person other than the Passholder. Access will be denied to an Passholder to any or all Attractions in the event of fraud or misuse of the Merlin Annual Pass. The Merlin Annual Pass will be cancelled and withdrawn from any person whose conduct is deemed to be inappropriate in the absolute discretion of Merlin Entertainments Group. Inappropriate conduct includes, but is not limited to, allowing or assisting a third party to attempt to gain unauthorised or improper access to any Attraction with a Merlin Annual Pass of which they are not the valid Passholder. For the avoidance of doubt no refund or other consideration (monetary or otherwise) will be given to the Passholder for cancellation in such circumstances.

27.          A Merlin Annual Pass that is discovered to have been purchased through illegal methods will be cancelled without compensation.

28.          A lost, stolen and/or damaged Merlin Annual Pass should be reported to Merlin Entertainments Group through the Attraction that issued the Merlin Annual Pass immediately. Contact details for each Attraction can be found on the Merlin Annual Pass website (www.merlinannualpass.com.au).

29.          In the event of a lost, stolen and/or damaged Merlin Annual Pass, Merlin Entertainments Group will re-issue the Passholder with a replacement Merlin Annual Pass. Up to three replacement Merlin Annual Passes can be issued during the Validity Period. Replacement Merlin Annual Passes will only be issued at the original issuing Attraction to the individual whose details have been provided in accordance with clause 9 and on presentation of identification to confirm the identity of the Passholder. An administration fee of $20 will be charged for the re-issue of each lost or damaged Merlin Annual Pass. The re-issue of stolen Merlin Annual Passes will also be subject to the $20 re-issue fee unless the holder can provide Merlin Entertainments Group with a relevant crime reference number when requesting that the Merlin Annual Pass is re-issued.

30.          Unless stated otherwise, a Merlin Annual Pass cannot be used in conjunction with any promotional offer, voucher or advance booking or with any other offer, discount or retail/restaurant incentive of an Attraction.

31.          Refunds and exchanges of Merlin Annual Passes are not available after purchase, other than as required by law in accordance with your statutory rights as a consumer in compliance with the Competition and Consumer Act 2010 (Cth).

32.          Merlin Entertainments Group is entitled to use Passholder’s details to contact them in relation to service information, including, but not being limited to, information about changes to these Terms, expiry and/or renewal reminders. Merlin Entertainments Group will not use Passholder’s details for marketing purposes unless that Passholder has opted in to receive such information at the time of purchasing the Merlin Annual Pass. Merlin Entertainments Group Privacy Policy will apply in respect of the collection, storage, use and dissemination by us of your personal information obtained through the purchase of a Merlin Annual Pass.

33.          The Merlin Entertainments Group is entitled, in its absolute discretion, to change the price payable for its Merlin Annual Pass at any time and for any reason and may from time to time offer pricing or promotional offers at specific Attractions, online, via telephone or through third party channels.

34.          The Merlin Entertainments Group reserves the right to vary these by giving Passholders no less than 30 days written notice of such variation by using the details provided in accordance with clause 9.

35.          On the presentation of a Merlin Annual Pass, Passholders may receive discounts and/or benefits from third parties. Such third parties are subject to change. Merlin Entertainments Group is entitled to remove and/or withdraw any or all third party discounts and/or benefits in its absolute discretion at any time and for any reason.

36.          Merlin Annual Passholders may be entitled to passholder rewards from time to time. Click here to see the currently available rewards and their terms and conditions. The rewards are subject to availability and Merlin Entertainments Group is entitled to remove and/or withdraw any or all rewards in its absolute discretion at any time and for any reason.
